Agreement of Use
The company site available at https://mysnapface.com, including any of its subdomains or sections ("Platform") is operated by WishHush, LLC. ("mysnapface.com" or "us"), a company incorporated in United States, with primary business address at 651 N Broad St, Middletown, DE, 19709. You can contact mysnapface.com through the contact form on the site.
This Agreement governs the access to, browsing of, and use of the Platform by customers ("Customer" or "Customers," as applicable), as well as the services offered through the Platform for the enhancement or transformation of illustrations, graphic designs, photographs, and other types of images allowed for such purposes ("Provided Solutions").
By accessing and using the Platform, the Customer fully accept and agree to be bound by these Agreement. We may modify these Agreement from time to time. In such a case, our company will provide a notice to the Customer by publishing the most current version. If our company make any material change to these Agreement, our company will provide additional notice to the Customer, such as by sending the Customer an email or displaying a prominent notice on our Platform. By continuing to use the Platform after any changes come into effect, the Customer agree to the revised Agreement. If the Customer do not wish to accept the revised Agreement, the Customer can close the Customer Account (as defined later on), without limiting imperative conditions under applicable regulations.
Some of the Provided Solutions may be subject to specific conditions or instructions, which will complete or, if they are contrary to the provisions herein, will replace the content of these Agreement, and which must be accepted by the Customer before starting the provision of the corresponding Service.
Likewise, with regard to the collections and use of the personal data, the Privacy Policy shall apply.
Provided Solutions
Through the Provided Solutions, the Customer may upload illustrations, graphic designs, photographs, or any other type of images in any format supported by the Platform ("Input"). These images can then be edited, upscaled, enhanced, and/or transformed using our AI-powered tools based on the Customer's instructions or prompts entered into the Platform ("Output" or "to Upscale," "to Transform," if applicable). The Input, Output, and Instructions are collectively referred to as the "Assets." The Customer is solely responsible for the content and use of the Assets.
The Provided Solutions are delivered according to the descriptions, information, and features outlined on the Platform or otherwise provided by mysnapface.com. These Solutions may be modified, updated, or removed, in whole or in part, at any time. Unless otherwise specified, any changes to the Provided Solutions or the introduction of new Solutions bymysnapface.com will be governed by this Agreement.
To use the Provided Solutions, the Customer must have internet access and cover any associated costs, as well as have the necessary equipment and software. It is the Customer's sole responsibility to ensure that the Provided Solutions meet their needs and that they possess the required equipment and software, covering any related expenses.
Registration
To access the Provided Solutions, the Customer must create an account on the Platform ("Account") by registering with their email or social media account, as permitted by the Platform. Important: The Customer must be of legal age.
The Customer undertakes to provide all the mandatory information required for the registration and also acknowledges that such information is authentic, truthful, and up to date. Should the Customer provide false, outdated or incomplete information, or should mysnapface.com have reasons to suspect that registration is fraudulent,mysnapface.com reserves the right to suspend or cancel the Customer's Account.
By registering, the Customer agrees to comply with the following rules:
• The Account will be used for any necessary notifications.
• Third parties must not be granted access to the Customer’s Account, nor should the Customer use a third party’s Account.
• The Customer is solely responsible for all activity conducted through their Account. If the Customer suspects unauthorized use, they must immediately notifymysnapface.com.
• mysnapface.com reserves the right to suspend or cancel the Customer’s Account if a breach of this Agreement is detected or if there is any security risk.
Use of the Provided Solutions
The Customer agrees to access and use the Provided Solutions only in accordance with these Agreement and in good faith, and not to use the Provided Solutions negligently or to perform or suggest activities prohibited by law or that violate the rights of third parties.
The Customer shall refrain from interfering with the Provided Solutions and, in particular, from impersonating a third party. Likewise, the Customer undertakes not to perform any act that damages, disables or overloads, impairs or prevents the normal use of the Provided Solutions or the Platform, which affects its security or that hinders or interferes with it.
Access to the Provided Solutions by robots, spiders or any other device, program, mobile application or tool to access, copy or control any part of the Platform, that is contrary to normal exploitation or that unjustifiably limits the interests ofmysnapface.com or of other Customers is prohibited. Likewise, it is prohibited to obtain or attempt to obtain the contents of the Platform or to use the Provided Solutions, using means or techniques different from those that imply the usual way of use or those expressly authorized by mysnapface.com.
The Customer undertakes not to carry out any conduct that could damage the image, interests, and rights of mysnapface.com, other Customers or third parties.
The following actions are strictly prohibited when providing Inputs and/or Instructions to the Provided Solutions or using any Outputs, including but not limited to:
• Using the service for unlawful, misleading, false, deceptive, harmful, threatening, abusive, harassing, defamatory, or immoral purposes, including activities related to pornography, spam, nudity, obscene gestures, or any other illegal activity that violates principles of good faith and public order.
• Infringing on any third-party intellectual property rights, including the unauthorized use of a person’s image, name, or any private or confidential information.
• Introducing viruses, worms, or any malicious code that could harm other users, networks, or systems.
• Generating political content, particularly for electoral campaigns, that misrepresents reality without clear identification as satire or parody (humor and parody are permitted if explicitly labeled as such).
• Violating principles related to legality, human dignity, the protection of minors, public order, privacy, or intellectual and industrial property rights.
• Acting in any manner that breaches these Terms or any guidelines and conditions set by mysnapface.com.
Regarding the Assets, mysnapface.com only exercises a merely technical, neutral and automatic role, without having any effective control over them. The Customer acknowledges and agrees that mysnapface.com does not endorse, warrant or approve any Asset, expressly excluding any liability in such regard.
We (mysnapface.com) act solely as distributors, not publishers, of the content provided by Customers. As such, we do not exert editorial control over this content, similar to a public library. Any opinions, advice, statements, services, offers, or other information shared by members, visitors, or third parties are solely those of the respective author(s). mysnapface.com is not responsible for any material posted by third parties, does not endorse it in any way, and expressly disclaims any liability related to such content.
Contracting the Provided Solutions
Procedure for contracting the Provided Solutions
The Provided Solutions shall be subject to remuneration as provided on the Platform. In particular, to enjoy the Provided Solutions, the Customer shall need to purchase a subscription ("Subscription"), with the number of monthly tokens that can be used by the Customer to Upscale / Transform the Inputs ("Tokens"). The description, pricing, term, number of Tokens, conditions, and characteristics of each Subscription are provided on the Platform and prior to its purchase by the Customer.
Prices include VAT or indirect taxes applicable to Provided Solutions, unless otherwise stated in the Platform. mysnapface.com reserves the right to modify the prices applicable to the Provided Solutions at any time before any purchase. Such modifications will be published on the Platform. If the modification applies to the price for the renewal of any Subscription, it shall be duly notified before renewal, so the Customer is able to cancel it.
Payment for the services must be made through the means of payment accepted at any time on the Platform. mysnapface.com uses secure payment gateways. mysnapface.com does not store, process or transmit payment data relating to the card itself or to the cardholder (such as card number, cardholder, expiration date, service code, electronic signature or authentication code of the cardholder, or bank account associated with the card). The payment entity will manage the payment according to the conditions the Customer has contracted for international purchases, which may imply that the value is modified according to the exchange rates applied or that the Customer is charged in a currency other than the one selected.
In the event the payment is declined. mysnapface.com may attempt to process the transaction again under the same conditions as the transaction was initiated by the Customer, within a few days of the Customer's first attempt to purchase the Provided Solutions. Where the payment is approved in such a circumstance, the Customer will receive an email confirming the successful completion of its transaction.
These Agreement, as our company as any particular conditions applicable to the Provided Solutions may be printed by the Customer at any time before any purchase.
Once a Customer purchases a Subscription, it will automatically renew for successive periods following the initial or previous payments. mysnapface.com will process the corresponding charges unless the Customer cancels the Subscription as outlined in the "Cancellation of the Provided Solutions" section.
The Customer will be informed in advance of the number of Tokens required to Upscale / Transform any Input and, upon confirmation of the Upscale / Transform by the Customer, such Tokens spent for the Upscaling / Transformation will be deducted from the total amount of available Tokens. The amount of Tokens available at any time shall be disclosed in the Platform.
Tokens Renewal
Unused monthly or yearly Tokens do not roll over. Tokens are automatically replenished when the subscription renews, and any unused Tokens from the current billing period will expire at the end of that period. Tokens will be replenished at the start of each billing cycle.
For clarification, each billing period begins on the same calendar day the Customer initially subscribed. For monthly plans, this occurs every month; for annual plans, this occurs every year. If the exact renewal date is not possible, Tokens will be replenished on the nearest available day before or after the scheduled renewal date.
Additionally, Customers may purchase ad hoc Tokens that do not expire. These Tokens will remain available indefinitely unless mysnapface.com becomes insolvent, in which case they may no longer be redeemable.
Right of withdrawal
For Customers in the United States, refund policies are governed by applicable federal and state laws rather than a statutory right of withdrawal. mysnapface.com offers a voluntary refund policy under the following conditions:
• If a Customer cancels a Subscription within fourteen (14) calendar days of purchase and has not used any Tokens or accessed the Provided Solutions, they may be eligible for a full refund.
• If the Customer has used Tokens or accessed the Provided Solutions during this period, a proportional refund may be issued based on the unused portion of the service.
• To request a refund, the Customer must submit a clear written request via email or through our contact form. While a specific withdrawal form is not required, it may be provided for convenience.
• Refund eligibility and processing are subject to mysnapface.com’s discretion and applicable consumer protection laws in the Customer’s state of residence.
This policy does not affect any additional rights the Customer may have under state law.
Modification or cancellation of the Provided Solutions
Cancellation
The Customer may request, at any time, the modification or cancellation of the Provided Solutions through his/her Account on the Upgrade section. The request for modification or cancellation will not affect the Provided Solutions that have already been contracted and paid, which will continue to be provided until the end of the period already paid and the anticipated amounts will not be refunded, without prejudice to the provisions regarding the right of withdrawal. The Customer Tokens will be set to zero at the end of the current billing cycle.
Intellectual property
mysnapface.com's intellectual property
The elements, functionalities and utilities integrated within the Provided Solutions and the Platform, including any content and material regarding the same, are owned by or licensed to mysnapface.com and are safeguarded under applicable intellectual property laws.
All content on our Platform (whether past, present or future versions), as our company as all of its functionalities, contents and elements are the property of mysnapface.com or its licensors and are protected by rights related to intellectual property, including, without limitation, (i) trademarks, logos and trade names; (ii) the format of the Provided Solutions offered by mysnapface.com; and (iii) other forms of intellectual property.
You acknowledge that any actions beyond the authorized use of the Platform, as outlined below, including but not limited to reproduction, distribution, public communication, modification, or transformation—such as marketing, decompilation, disassembly, reverse engineering, or any attempt to obtain the Platform’s source code (except where expressly permitted by applicable law)—constitute an infringement of intellectual property rights owned by or licensed to mysnapface.com. Accordingly, you agree not to engage in any of these prohibited activities.
Subject to compliance with these Terms, mysnapface.com grants the Customer a non-exclusive, limited, revocable, personal, and non-transferable license to use the Platform solely for the purpose of accessing the Provided Solutions, as permitted under these Terms. All other intellectual property rights related to the Provided Solutions, the Platform, and its components remain exclusively reserved by mysnapface.com.
Content uploaded and generated by the Customer
The Provided Solutions enable Customers to upload and submit content, including Inputs and Instructions, to the Platform. These are processed using AI-powered tools provided by mysnapface.com to generate Outputs.
These Agreement do not grant mysnapface.com any ownership to the content uploaded by the Customer or generated by the Provided Solutions, except for the rights granted under these Agreement that allow us to offer and improve the Provided Solutions. In this regard, all content uploaded by the Customer and generated by the Provided Solutions following the Customer's Instructions is the sole and exclusive responsibility of the Customer and not of mysnapface.com.
mysnapface.com requires a license from the Customer with respect to the content of the Assets with the sole purposes of providing and improving the Provided Solutions, comply with applicable law, enforce our Agreement and keep our Provided Solutions safe. Solely for this purpose and until the Customer remove the content from the Provided Solutions, the Customer agree and acknowledge that by using the Provided Solutions, the Customer grant to mysnapface.com, its successors, and assigns a indefinite, worldwide, unlimited, non-exclusive, sublicensable, free license to (i) use, host, store, scan, make a copy, search, classify, index, and (ii) reproduce, communicate, publicly display, distribute and transform (including, but not limited to Upscaling, Transforming, trimming, editing and adapting), the Assets. For clarification purposes, mysnapface.com will not sell or advertise or make any commercial use of the contents of the Assets, in accordance with the provisions of these Agreement.
mysnapface.com's liability for the Provided Solutions
The Customer shall be solely liable for any damages arising to mysnapface.com or to any third party resulting from or related to any unlawful, unauthorized or improper access, or use of the Platform, the Provided Solutions or its contents in breach of these Agreement, and undertake to hold mysnapface.com and its administrators, personnel, agents and representatives harmless from any liability they may incur as a result of such breach.
To the full extent permitted by applicable law, the Customer agree that in no event shall mysnapface.com be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if any mysnapface.com has been advised of the possibility of such damages) arising out of or in connection with (a) the inability to use the Platform or the Provided Solutions (without limiting the cause, including our negligence), (b) statements or conduct of or transactions withmysnapface.com or within the Provided Solutions, (c) the Customer use of the Provided Solutions or the Platform, or (d) any other matter relating to mysnapface.com. Our liability to the Customer or any third parties in any circumstance shall be limited to the greater of $10 or the amount of pricing, if any, the Customer paid to us in the 12 months prior to the action that may give rise to liability.
mysnapface.com may contain links to third-party websites or apps that are not owned or controlled by us. mysnapface.com has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or apps. We strongly encourage Customers to review the terms of service and privacy policies of any third-party websites or apps they visit.
The Customer expressly understands and agrees that:
• Use of the Provided Solutions is at the Customer’s sole risk.
• To the fullest extent permitted by applicable law, mysnapface.com does not guarantee that:
o The Provided Solutions will meet any specific requirements.
o The Provided Solutions will be uninterrupted, secure, updated, or error-free.
o The results obtained from using the Provided Solutions will be accurate, reliable, or suitable for any particular purpose.
o The quality of any service, information, or materials obtained through the Provided Solutions will meet expectations.
o Any errors or defects will be corrected.
• No data transmission over the Internet can be guaranteed to be completely secure. While mysnapface.com takes measures to protect customer information, we do not warrant or guarantee the security of any data transmitted to us. Customers transmit information at their own risk.
mysnapface.com is not liable for damages arising from, including but not limited to:
• Interruptions, viruses, technical failures, power outages, communication system failures, or other disruptions beyond mysnapface.com's control.
• Delays or unavailability of the Provided Solutions due to traffic overloads on the Internet, communication networks, or electricity grid issues.
• Actions by third parties.
• Downtime due to maintenance, software updates, or other necessary operational activities.
• Any other circumstances beyond mysnapface.com’s control.
Jurisdiction and Applicable Law
This Legal Notice is governed by United States legislation. Customers of The Service submit to the United States jurisdiction, expressly waiving any other jurisdiction that may correspond to them under the law.
Termination
mysnapface.com reserves the right to deny or revoke a Customer’s access to the Platform or the Provided Solutions if the Customer fails to comply with, or if mysnapface.com reasonably suspects a violation of, these Terms. mysnapface.com may enforce such termination with a simple notification, and in such cases, will bear no liability for the termination and will not be obligated to issue any refunds for payments already made.
The Customer may terminate the Provided Solutions and cancel their Account by contactingmysnapface.com support and following the designated cancellation procedure, subject to the terms outlined in the "Cancellation of the Provided Solutions" section.
Modifications
mysnapface.com, may at any time and without incurring any liability, vary the content of the Platform or the Provided Solutions or interrupt the provision of all or some Provided Solutions, without limitation other than those established by the applicable regulations.
General
These Agreement are subject to United States Law and the Customers submit to the jurisdiction of the Courts of Delaware (United States), expressly waiving any other jurisdiction that may correspond to them, unless the Customer's condition (e.g. as a consumer) makes it mandatory to apply any other legislation or jurisdiction.
In the event that any of the provisions contained in these Agreement is declared null and void, it will be withdrawn or replaced. In any case, such declaration of invalidity will not affect the validity of the other provisions contained in these Agreement.
